Welcome to getposhak.com (the "Website"). These Terms of Service ("Terms") govern your access to and use of the Website, the Poshak web application, and the fashion catalog rendering services provided by Poshak (collectively, the "Service").
By accessing, browsing, registering for an account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, boutique, D2C brand, or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the Service.
1. Platform Description & Service Delivery
Poshak provides a garment rendering and fashion cataloging software service. The Service allows users to upload flat-lay, mannequin, or basic hanger photographs of physical garments (such as sarees, lehengas, kurtis, dresses, and shirts) and process them through our image rendering software to generate on-model catalog photography.
The Service is delivered as a software-as-a-service (SaaS) platform. We do not provide physical models, photography equipment, or physical studio shoots under the standard digital plans unless explicitly subscribed to under our "Studio Hybrid" or bespoke custom enterprise agreements.
2. User Accounts & Registration
To access most features of the Service, you must register for an account at app.getposhak.com. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
You are solely responsible for safeguarding the credentials (email, password, or login tokens) used to access your account. You agree to notify us immediately of any unauthorized access or use of your account. Poshak will not be liable for any loss or damage arising from your failure to comply with this security obligation.
3. Intellectual Property Rights & Commercial Use Licenses
User Content & Garment Rights:You retain all ownership rights, copyrights, and design rights in the physical garment designs, patterns, and source photographs you upload to the Service ("User Content"). By uploading User Content, you grant Poshak a worldwide, royalty-free, limited, non-exclusive license to store, process, modify, and run image processing on the User Content solely for the purpose of generating your on-model output images. We do not claim ownership over your original garments or designs.
Generated Outputs:Upon successful generation of the on-model catalog images ("Outputs") and deduction of the corresponding credits, Poshak grants you a perpetual, worldwide, fully paid-up, royalty-free, non-exclusive license to use, copy, display, distribute, modify, and publish the Outputs for any commercial, marketing, or advertising purposes. This includes listing on third-party e-commerce marketplaces (such as Amazon, Myntra, Flipkart, and Shopify), print media, and social media networks.
Platform Proprietary Rights:Except for User Content, the Service and all materials therein, including software, algorithms, designs, graphics, code, and trade name "Poshak" are the exclusive property of Poshak. You agree not to copy, reverse-engineer, decompile, or attempt to extract the source code of our rendering software.
4. Credit System, Payments & Refunds
Billing and Credits: Access to the image rendering Service is metered via digital credits. Credits are purchased in pre-paid packages (e.g., Starter Pack, Growth Pack, etc.) as detailed on our Website. All pricing is subject to standard Goods and Services Tax (GST) of 18% in India, which will be added at checkout.
Secure Processing: All payments are processed securely through integrated third-party payment gateways. Poshak does not store your credit card or sensitive financial credentials.
Refund Policy: Due to the high compute and processing costs associated with image rendering, all credit purchases are final and non-refundable. If an image generation fails technically or outputs major rendering anomalies, you may submit a request to support@getposhak.com within forty-eight (48) hours of the generation, and we will refund the credit to your account balance upon verification.
5. Representation Disclaimer & Quality Variance
The Service is provided on an "as is" and "as available" basis. Our image rendering software simulates lighting, fabric drapes, textures, and folds based on automated image processing algorithms. While Poshak employs advanced fabric preservation methods, minor variances in fabric color, lighting hues, drape alignment, and pattern scaling may occur between the physical garment and the digital rendering.
User Responsibility:It is the User's sole responsibility to verify that the final Outputs accurately and adequately represent their physical stock before publishing the listings to any marketplace. Poshak is not liable for customer returns, consumer disputes, or marketplace penalties resulting from differences between physical garments and rendered catalog photos.
6. Acceptable Use & Prohibited Activities
You agree not to use the Service, or permit any third party to use the Service, to:
- Upload photographs of garments or designs that infringe upon the intellectual property, copyright, patent, or design rights of any third-party brand or manufacturer.
- Upload obscene, offensive, hateful, or illegal apparel designs.
- Use the outputs for deceptive or fraudulent advertising purposes.
- Use scrapers, robots, spiders, or automated scripts to systematically download catalog images or access account areas.
- Attempt to disrupt, overload, or compromise the security and stability of our cloud servers and rendering pipelines.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Poshak, its founders, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, sales, or other intangible losses, arising from (i) your access to or use of the Service; (ii) any platform downtime or GPU queue delays; or (iii) any quality discrepancies between physical garments and digital outputs.
In no event shall Poshak's total aggregate liability for all claims related to the Service exceed the total amount paid by you to Poshak for the Service in the three (3) months immediately preceding the event giving rise to the claim.
8. Governing Law & Dispute Resolution
These Terms shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
